Hi,

About 3 weeks ago I approached a landlord regarding his property which was available for rent. He agreed that I could rent the property and agreed to me getting the place ready before I move in as I am to get married shortly (2.5 weeks from today). He also gave me the key to the property. He said that we'll finalise everything once he has appointed a new agent. I went ahead and had the place painted and spent a significant amount of money on having cupboards made for the bedrooms and kitchens to the size of the rooms.

Yesterday I was contacted by the agent and was told that I have to go through an application process and if I do not qualify I will not get the place. This 2 weeks before my wedding!

I told the agent that the landlord and I concluded a verbal lease agreement, before they became the agent for the property, which was ratified by him giving me the key to the property and that I already am a tenant and that I need not go through an application process.

I understand why they would want to do a credit and reference check, but the fact that they are now telling me that there is no guarantee that I will qualify to lease the property is unacceptable, especially after a verbal lease agreement was concluded.

I would like to know what I can do now. Any advice please?

Verbal lease agreements are difficult and you have little or no proof of any agreement or the terms thereof. You do have the keys as proof and you are paying rental, so there is deemed to be a verbal agreement. In order for the agent to get you out of the premises, she would have to cancel based on a material breach. I do, however, suggest you speak with the owner and get a lease drafted with the original terms and conditions as this will just become a matter of he-said-she-said.
